Terms of Service

1. Agreement to These Terms

Dreamcatcher is an AI creative production platform provided by 44pixels Limited ("44pixels", "we", "us", or "our"). By accessing or using Dreamcatcher, you agree to these Terms of Service and the policies linked from them. If you use Dreamcatcher for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

If you have a separate written agreement or order form with 44pixels, that agreement controls to the extent it conflicts with these terms.

2. Access, Accounts, and Organizations

Dreamcatcher may be offered through a private beta, waitlist, pilot, or paid subscription. We may approve, deny, limit, or revoke access where needed to protect the service, comply with law, or run the beta responsibly.

You are responsible for the accuracy of your account information, the security of your login credentials, and all activity in organizations where you are an owner, admin, member, or service account user. Organization owners and admins are responsible for inviting the right users, removing users who should no longer have access, and ensuring that service accounts and connected integrations are used only for authorized business purposes.

3. The Service

Dreamcatcher helps creative and performance teams collect creative signals, create workflow canvases, build production variants, and generate or transform assets using AI models and connected services. Features, limits, models, credit costs, and availability may change as we improve the product or respond to provider, safety, legal, or infrastructure constraints.

AI systems can produce inaccurate, unexpected, similar, or unsuitable outputs. You are responsible for reviewing all generated content before using, publishing, distributing, or relying on it.

4. Customer Content and Outputs

"Customer Content" means prompts, briefs, product data, brand materials, references, uploaded files, connected account data, generated outputs, and other materials submitted to or created through your account. As between you and 44pixels, you retain your rights in Customer Content. You grant us a worldwide, non-exclusive license to host, process, transmit, display, reproduce, modify, and create derivative works from Customer Content only as needed to provide, secure, support, meter, and improve Dreamcatcher and to comply with law.

Subject to these terms, your subscription, and applicable third-party provider terms, you may use outputs generated through your account for your business purposes. You are responsible for confirming that you have the rights, releases, licenses, consents, and platform permissions needed for your inputs and your use of outputs.

Dreamcatcher, including its software, user interface, workflows, documentation, models of operation, templates, metadata schemas, analytics, and platform technology, remains owned by 44pixels and its licensors. You may not copy, reverse engineer, resell, or use Dreamcatcher to build a competing service except where law expressly permits.

5. Synthetic Media and Public Use

You may not use Dreamcatcher to impersonate a real person, clone or simulate a person's voice, likeness, or persona, or imply endorsement by a person, brand, or organization unless you have all required permissions. You are responsible for complying with advertising, platform, creator, disclosure, intellectual property, consumer protection, and synthetic-media rules that apply to your campaigns and distribution channels.

If you publish AI-generated or AI-assisted content, you are responsible for any required labels, disclosures, review, substantiation, and moderation.

6. Billing, Plans, Credits, and Taxes

Paid subscriptions and top-ups are processed through Stripe. You must provide complete and accurate billing information and authorize 44pixels and Stripe to charge your payment method for subscriptions, renewals, top-ups, taxes, and other amounts you approve. If payment fails, we may suspend, downgrade, or limit access until amounts are paid.

Credits are usage units for Dreamcatcher generation and workflow actions. They are not cash, stored value, gift cards, or refundable currency. Subscription credits are included with the applicable plan and may reset or expire at the end of each billing cycle. Purchased top-up credits are intended to remain available while your account is active, unless required otherwise by law or your account is terminated for misuse, non-payment, or legal reasons.

Fees are non-refundable except where required by law or expressly stated in a separate written agreement. We may change pricing, credit costs, bundles, limits, or included features, but subscription price increases will apply no earlier than your next renewal after notice where required.

7. Acceptable Use

You may not use Dreamcatcher to create, upload, generate, automate, or distribute content or activity that is unlawful, harmful, deceptive, defamatory, abusive, exploitative, discriminatory, infringing, privacy-invasive, sexually exploitative, violent, malware-related, spam-related, or intended to manipulate or mislead people in high-impact contexts. You also may not bypass security controls, interfere with the service, scrape or overload systems, probe for vulnerabilities without authorization, or use Dreamcatcher in violation of another service's terms.

We may remove content, disable workflows, throttle usage, suspend accounts, or report activity when we believe it is necessary to protect Dreamcatcher, our users, third parties, or the public.

8. Third-Party Services and Integrations

Dreamcatcher uses third-party providers for AI models, hosting, authentication, storage, analytics, error monitoring, billing, email, and integrations. These providers may have their own terms, policies, account requirements, usage limits, moderation rules, data practices, and availability constraints. We are not responsible for third-party outages, rejected requests, model behavior, policy changes, or integration changes outside our control.

9. Confidentiality and Feedback

During beta or partner pilots, you may receive non-public information about Dreamcatcher. You must protect that information with reasonable care and use it only to evaluate or use the service. If you provide ideas, feedback, or suggestions, we may use them without restriction or compensation.

10. Availability, Changes, and Termination

Dreamcatcher is provided on an as-available basis. We may modify, suspend, or discontinue features; impose or change limits; or block access where needed for reliability, safety, legal compliance, provider constraints, or product changes. You may stop using Dreamcatcher at any time. We may suspend or terminate access if you breach these terms, fail to pay, create risk for the service, or use the service unlawfully.

11. Disclaimers, Liability, and Indemnity

To the maximum extent permitted by law, Dreamcatcher is provided without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free output. We do not warrant that generated content will be unique, accurate, safe, lawful, platform-compliant, or suitable for your intended use.

To the maximum extent permitted by law, 44pixels will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or substitute services. Our aggregate liability for claims relating to Dreamcatcher will not exceed the amounts you paid to 44pixels for the service in the three months before the event giving rise to the claim, or USD $100 if you have not paid us.

You will defend, indemnify, and hold harmless 44pixels from claims arising from your Customer Content, your use of outputs, your breach of these terms, your violation of law, or your violation of third-party rights.

12. Changes, Law, and Contact

We may update these terms from time to time by posting a revised version and updating the date above. Continued use after changes means you accept the revised terms. Unless a separate written agreement says otherwise, these terms are governed by the laws of England and Wales, without regard to conflict-of-law rules.
